The famous host has been sued for using three jokes in his TBS late-night show monologue that weren’t his. The trial is about to determine whether his writers took some material from a freelancer’s blog and social media.

A guy named Robert “Alex” Kaseberg claims he came up with thousands of jokes, including some about Tom Brady, Caitlyn Jenner, and the Washington Monument, used by O’Brien on his show.

The defendants are arguing that the jokes used common expressions and known facts and were so undeserving of extensive protection.
